Do I have any tax liability if I win a raffle?
The taxable value of the prize will be treated as ordinary income to the raffle winner for federal and state income tax purposes, and each raffle winner will be required by federal and state law to pay any tax liability incurred in connection with his/her receipt of the prize. However, the raffle sponsor will help mitigate the tax liability for winners of prizes with a fair market value of $5,000.00 or more. For prizes worth $5,000.00 or more, the raffle sponsor will donate an amount equal to 33.33% of the fair market value of said prize and remit the same directly to the IRS on behalf of the raffle winner. Nothing contained in this section shall be construed such that anyone other than the raffle winner is responsible for the raffle winner's tax liability that is created when the raffle winner claims his or her prize(s). This provision is meant only to mitigate, not eliminate, the raffle winner's tax liability from winning the prize(s). The amount paid by the raffle sponsor may or may not be enough to defray the entire tax burden associated with winning the raffle. If you are a raffle winner, it is important that you determine what federal, state and/or local taxes you must pay and you are encouraged to consult with an accountant or tax preparer to make that determination.
